European Commission – Study on Contractual Practices Affecting the Transfer of Copyright and Related Rights

This study provides an overview of the contractual practices used in certain creative sectors, such as the audiovisual sector, music, visual arts, video games, and literary works, focusing on the transfer of copyright and related rights from creators/performers and audiovisual producers to third parties exploiting these rights.

It also analyzes the use of contractual practices involving full transfer of rights, such as buyout contracts, and evaluates how these practices affect creators’ remuneration and producers’ ability to invest in creative content.
The study further examines the relevant provisions of Directive 2019/790 on copyright regarding creators’ and performers’ remuneration and identifies the corresponding national rules in the field of copyright and contract law.
Finally, it explores the issue of choice of law and jurisdiction in contractual agreements.
