European Commission – Consultation on the Commission’s Guidelines for Clarifying the Scope of the General Rules for Artificial Intelligence in the AI Act

On 22 April, the Commission issued a press release seeking to contribute to the clarification of rules concerning general-purpose AI (GPAI) models and inviting stakeholders to draw on their practical experience to help shape clear and accessible EU rules for GPAI models through a targeted consultation that will contribute to the upcoming Commission guidelines.

The guidelines will clarify key concepts underpinning the AI Act’s provisions regarding GPAI models and will provide detailed explanations on issues such as “what constitutes a general-purpose AI model,” “which entities qualify as providers in various configurations,” and “which actions amount to placing on the market.” The guidelines will also outline how the AI Office will provide support to facilitate compliance. Finally, they will explain how signing a code of conduct, once approved by the AI Office and the AI Board, can reduce the administrative burden for providers and serve as a benchmark for regulatory compliance. In this context, the guidelines will complement the Code of Practice on GPAI, which is currently being finalized.

All interested parties, including GPAI model providers, civil society, academia, other experts, and public authorities, are invited to submit feedback on the consultation by 22 May. While the guidelines will not be legally binding, they will clarify how the Commission, which is responsible for supervising and enforcing GPAI-related rules, interprets and applies these rules under the AI Act.

Both the guidelines and the final Code of Practice are expected to be published before August 2025.
