Copyright Global Talks – Webinar No 3: «The Court of Justice‘s Plehman II ruling: Creativity panacea or pipedream?» Keynote Speaker: Dr. Bernd Justin Jütte, Accociate Professor in Intellectual Property Law, University College Dublin, Sutherland School of Law

The Hellenic Copyright Organization organises and invites you to attend a webinar entitled “The Court of Justice’s Pelham II ruling: Creativity panacea or pipedream?”, featuring keynote speaker Dr. Bernd Justin Jütte, Associate Professor in Intellectual Property Law, University College Dublin, Sutherland School of Law.

This webinar is the third episode of the Copyright Global Talks series, which launched successfully in 2025.

During his presentation, Dr. Bernd Justin Jütte will analyse the judgment of the Court of Justice of the European Union in Case C-590/23 (Pelham II), delivered on 14 April 2026 by the Grand Chamber — the first binding interpretation of the pastiche exception under Article 5(3)(k) of the InfoSoc Directive. The discussion will focus on the delineation of “pastiche” as an autonomous concept of EU law, the requirement of an objectively recognisable artistic or creative dialogue with the source material, and the implications of the ruling for the practice of music sampling and, more broadly, for the creative reuse of copyright-protected content.
