Organization for Economic Cooperation and Development (OECD) – Report on Intellectual Property and Data Collection in the Age of Artificial Intelligence

This OECD report, published on 9 February 2025, is the result of the OECD’s Artificial Intelligence Governance Working (AIGO) and the Global Partnership on Artificial Intelligence (GPAI).

It offers an in-depth analysis of the legal and regulatory issues raised by the use of data in the context of Artificial Intelligence, as well as providing a detailed overview of the legal challenges related to intellectual property rights, with a particular focus on the use of data extracted through automated collection techniques, such as data scraping. This process involves the automatic extraction of data from websites, databases and social networks and highlights the implications that collecting such data without the consent of the creators or rights holders can have. It also recognizes the need for a balanced approach that enables innovation in Artificial Intelligence, while ensuring the protection of intellectual property rights, and suggests the following practices to resolve the issues:
