European Parliament Think Tank – Study on Generative AI and Copyright

A new study conducted for the European Parliament Think Tank, by the Policy Department for Citizens’ Rights and Constitutional Affairs (Policy Department C), at the request of the Committee on Legal Affairs (JURI), sheds light on critical questions regarding the impact of generative artificial intelligence (AI) on EU copyright law.

The study highlights:

  • The legal mismatch between AI training practices and existing text and data mining (TDM) exceptions,

  • The uncertainty surrounding the ownership and protection of AI-generated content,

  • The systemic implications for Europe’s creative economy and fair remuneration of creators.

The report proposes a coherent regulatory framework that includes:

  • Clear legal distinctions between inputs and outputs in AI training and content generation,

  • Harmonised opt-out mechanisms for creators who do not wish their works to be used,

  • Transparency obligations for AI systems that utilise protected content,

  • Fair and balanced licensing models to ensure the sustainability of creative work in Europe.

It also stresses the need for legislative action by the European Parliament to ensure a balanced transition to the AI era, where innovation coexists with respect for creators’ rights.
