The Court of Justice of the European Union issued on 09/11/2023 a decision in case C-376/22 regarding the fight against illegal content on the Internet, according to which a Member State cannot impose on a communication platform provider established in another Member State of the EU general and abstract obligations.

Such a national approach is contrary to EU law, which ensures the free movement of information society services through the principle of control in the Member State of origin of the service concerned.
